The Verkhovna Rada supported the draft law No. 15111-d on the taxation of income from digital platforms in its first reading. A total of 234 members of parliament voted in favor.<\/p>\n<\/p>\n

While the Cabinet of Ministers submitted No. 15111 to parliament, today, April 7, the members of parliament supported an alternative version No. 15111-d in the first reading, which includes significant changes.<\/p>\n As reported by MP Yaroslav Zheleznyak, the document was significantly revised, taking into account the comments from businesses and alternative proposals from members of parliament.<\/p>\n The rules apply to those who sell goods, rent out real estate or transport, or provide services through online services.<\/p>\n This concerns Ukrainian and foreign companies<\/strong> providing digital services that actively operate in our market (such as Bolt, Uklon, Airbnb, Globo, Uber<\/strong>, and other services for providing services, selling goods, renting real estate or transport, etc.).<\/p>\n Who is not affected<\/p>\n Information about sellers will not be transmitted to the Tax Service in the following cases:<\/strong><\/p>\n No special accounts<\/p>\n According to him, the updated version of the bill has become significantly more lenient towards citizens and entrepreneurs.<\/p>\n “This is a revised text that we have significantly improved. It no longer concerns used goods, there are no special accounts or access to banking secrecy<\/strong>,” Zheleznyak wrote on his Telegram channel.<\/p>\n Special tax regime of 5%<\/p>\n For those who work through platforms on a regular basis, a simplified system is introduced: the tax rate is 5% of personal income tax (instead of the standard 18%).<\/strong><\/p>\n Who can benefit: individuals without hired workers who do not sell excise goods and have an annual income of up to 7.2 million UAH (834 minimum wages).<\/strong><\/p>\n The role of the platform: the platform operator acts as a tax agent (withholds and pays tax on behalf of the user). There is no need to submit declarations or open special accounts. The tax is calculated by the State Tax Service based on data from the platforms.<\/strong><\/p>\n Main obligations for platform owners (OLX, Uber, etc.)<\/p>\n Operators of digital platforms will be required to:<\/strong><\/p>\n The absence of labor relations – income from providing personal services through the platform does not create official labor relations between the platform and the seller.<\/p>\n Information exchange<\/p>\n Draft No. 15111-d takes into account EU rules on the exchange of tax information regarding the sale of goods and the provision of services through digital platforms.<\/p>\n International information exchange will not begin until Ukraine joins the relevant multilateral international treaty (Multilateral DPI Agreement), which currently has 33 countries as parties (including almost all EU member states).<\/p>\n Foreign platform operators (non-residents) will have simplified rules: reporting can be submitted once a year through a special portal, and taxes can be paid monthly in foreign currency.<\/p>\n When the changes will take effect<\/p>\n It is expected that the new norms will be able to come into effect no earlier than January 1, 2027.<\/strong><\/p>\n Most provisions will only come into effect after Ukraine joins the international DPI agreement:<\/p>\n The Ministry of Finance expects that this will legalize income, particularly regarding the status of couriers, taxi drivers, and other participants in the gig economy.<\/p>\n Individual entrepreneurs are allowed<\/strong>: to conduct activities through platforms in areas that are not officially registered.<\/p>\n Important<\/strong>: the bill is currently being prepared for a second reading in the relevant committee of the Verkhovna Rada, where it will be further refined.<\/p>\n In fact, the taxation of income will only begin in 2028 (based on the results of the reporting year 2027).<\/strong><\/p>\n Recall that on March 10, the Verkhovna Rada of Ukraine was unable to adopt the previous draft law No. 14025 on the taxation of digital platforms – the document received only 168 votes out of the required 226.<\/p>\n The International Monetary Fund expressed concern regarding further financing of Ukraine under the program of $8.1 billion. The reason was the delay in making decisions necessary to receive these funds, as the draft law on the taxation of digital platforms is one of the key “beacons” for the IMF.<\/p>\n<\/p>\n In turn, the Cabinet of Ministers of Ukraine has begun preparing a new package of tax changes.
